3 Reasons Couples Consider Divorce Mediation

Divorce doesn’t have to bring out the worst in people. For divorcing couples who choose to work together, there is a process that provides them with control, flexibility and confidentiality to make their own decisions.

More divorcing couples are choosing mediation to resolve their issues relating to children, assets and support. In private mediation, spouses work with a mediation lawyer to develop an agreement that both parties believe is fair. This method can be used in a broad range of contexts, offering spouses many benefits, including:

  • control to reach a fair settlement without a courtroom or a judge
  • a flexible process that is not confined to conventional legal standards
  • assurance that any issues raised in mediation sessions are confidential


In mediation, divorcing couples choose the topics they want to discuss and lead their own negotiation process. Spouses have the freedom to seek legal advice from their own attorney outside of the couple’s joint mediation sessions.


Mediation allows couples to arrive at a resolution based on their own ideas of what’s fair in their situation. When settlements aren’t confined by rigid legal principles of a courtroom or a judge, spouses are not bound by standard means of resolving their issues.


Mediation is a confidential process with no public records available for anyone to view. Decisions are made in a private conference room, protected by the confidentiality agreement between the parties and the mediator.

While mediation is not the best solution for every divorce, it can provide you and your soon-to-be ex-spouse with a neutral atmosphere where you both can feel comfortable being open and honest.
